Motorcyclists can be uniquely vulnerable to the negligence of other drivers on the roadways. Motorcycle riders are in a less protected form of transportation and are oftentimes missed by drivers who are not careful, attentive and providing adequate focus to roadway conditions. The consequences to motorcycle riders can be catastrophic. They can suffer serious injuries and death in a motorcycle accident.

Overall, motorcycle riders are 26 times more likely to be killed in a motorcycle accident than an occupant of a passenger vehicle and are 5 times more likely to be injured. In addition, in two-thirds of motorcycle accidents, the driver of a passenger vehicle or other vehicle involved in the accident failed to observe the motorcycle, violating the motorcycle’s right of way and causing the accident.

Victims of motorcycle accidents may suffer damages including medical expenses, lost wages and pain and suffering damages. When a negligent driver has caused the motorcycle accident, legal options are available to protect motorcycle accident victims and their families. Legal remedies can hold negligent drivers accountable and help victims and their families recover damages for the injuries and harm they have suffered. In some circumstances, such as in Louisiana, even if the motorcyclist is partially responsible for the motorcycle accident, they will still be able to recover damages reduced only by their own fault in the accident.

The physical, financial and emotional harm the victim of a motorcycle accident may suffer can be unthinkable. As a result, it is important for victims and their families to be familiar with the legal resources available to help them following a motorcycle accident.
